EULA & Privacy Policy

This document contains the End User License Agreement ("EULA") and the Privacy Policy that govern your use of the Telestory Telegram bot, Android application, website telestory.net, and any related services (collectively, the "Software Product"). The Software Product is provided by Telestory ("Telestory", "we", "us"). By installing, accessing, or using the Software Product, you confirm that you have read, understood, and agreed to the terms below. If you do not agree, please do not install or use the Software Product.

1. Acceptance of Terms

This EULA is a legal agreement between you (either an individual or a single entity) and Telestory. By tapping "Start", "I agree", downloading, installing, or otherwise using the Software Product, you represent that: • you have reached the age of legal majority in your jurisdiction of residence, or you use the Software Product with the consent of your legal representative; • if you are accessing the Software Product on behalf of an organization, you are duly authorized to bind that organization to this EULA; • you accept all the terms set out in this document, including the Privacy Policy below.

2. Grant of License

Subject to your compliance with this EULA, Telestory grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Software Product on devices that you own or control, solely for your personal, non-commercial use. The Software Product is licensed to you, not sold. Telestory and its licensors retain all right, title, and interest in and to the Software Product, including all copyrights, trade secrets, trademarks and other intellectual property rights. You shall not remove any product identification, copyright notices or proprietary restrictions from the Software Product. All rights not expressly granted to you in this EULA are reserved by Telestory and its suppliers.

3. Distribution Channels and Platform Terms

The Software Product is distributed through several channels: • as a Telegram bot (@tele_story_bot) operating inside the Telegram messenger; • as an Android application available through the Google Play Store and RuStore; • via the website telestory.net. When you obtain or use the Software Product through a third-party platform (Telegram, Google Play, RuStore, or any other store), your use is also subject to that platform's own terms of service and end user agreements. In the event of a conflict between platform terms and this EULA, the more restrictive terms shall control with respect to that specific platform's distribution. Telestory is not responsible for the operation, availability, or policies of these third-party platforms.

4. Restrictions

You agree not to, and will not permit any third party to: • copy, modify, adapt, translate, or create derivative works of the Software Product, except as expressly permitted by this EULA or applicable law; • reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the Software Product, except to the extent such restriction is expressly prohibited by applicable law; • rent, lease, lend, sell, sublicense, distribute, host as a service, or otherwise transfer the Software Product to any third party; • use the Software Product for commercial timesharing, bureau use, or any commercial resale of its features; • use the Software Product to interfere with, disrupt, attack, overload or gain unauthorized access to any network, system, account, or service, including Telegram's infrastructure; • use the Software Product in any manner that violates Telegram's terms of service or any other third-party rights; • use the Software Product in violation of any applicable law, regulation, sanctions or third-party right.

5. Updates and Third-Party Components

Telestory may, at its discretion, provide updates, upgrades, patches, bug fixes, or new versions of the Software Product, and may add, modify or remove features at any time. Such updates are governed by this EULA unless accompanied by separate terms; in case of a conflict, the separate terms prevail with respect to the relevant update. The Software Product may include third-party software components (including open-source components and SDKs from analytics or advertising providers), which are licensed under their own terms. To the extent any third-party license terms conflict with this EULA, the third-party terms govern with respect to that specific component. Telestory makes no warranty or representation with respect to any third-party hardware or software with which the Software Product is designed to be used, and disclaims all liability with respect to any failures thereof.

6. Term and Termination

This EULA remains in effect until terminated. Your rights under this EULA will terminate automatically and without notice if you fail to comply with any of its terms. Telestory may also suspend or terminate your access at any time if it reasonably believes that you have breached this EULA, abused the Software Product, or used it in a manner that may cause harm to Telestory, other users, or third parties. Upon termination, you must cease all use of the Software Product and delete any copies in your possession or control. Sections 4, 7, 8, 9, 10, 11 and 12 survive termination.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE PRODUCT IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TELESTORY AND ITS SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND FREEDOM FROM VIRUSES OR OTHER HARMFUL COMPONENTS. TELESTORY DOES NOT WARRANT THAT THE SOFTWARE PRODUCT WILL MEET YOUR REQUIREMENTS, OPERATE UNINTERRUPTED, BE SECURE OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. THE SOFTWARE PRODUCT INTERACTS WITH THE TELEGRAM PLATFORM, WHICH IS OPERATED INDEPENDENTLY: TELESTORY DOES NOT GUARANTEE THE AVAILABILITY OF, OR ACCESS TO, THE STORIES OR PROFILES OF ANY SPECIFIC TELEGRAM USER, AND THE AVAILABILITY OF SUCH CONTENT MAY BE AFFECTED AT ANY TIME BY TELEGRAM, BY THE CONTENT AUTHOR, OR BY OTHER FACTORS BEYOND OUR CONTROL. Your use of the Software Product is at your sole risk. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply to the maximum extent permitted by law.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TELESTORY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, LOSS OF PRIVACY, DAMAGE TO DEVICES OR NETWORKS, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SOFTWARE PRODUCT, EVEN IF TELESTORY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. TELESTORY'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THIS EULA OR THE SOFTWARE PRODUCT, REGARDLESS OF THE FORM OF ACTION, SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TELESTORY FOR THE SOFTWARE PRODUCT IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) TEN US DOLLARS (USD 10). Nothing in this section excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Telestory and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your use or misuse of the Software Product, (b) your violation of this EULA or any applicable law, regulation or third-party right, or (c) your negligent act, omission or willful misconduct.

10. Export Control and Sanctions

You represent that you are not located in, and will not use the Software Product from, any country subject to a comprehensive trade embargo, and that you are not on any government list of prohibited or restricted parties. You agree to comply with all applicable export control and sanctions laws and not to use the Software Product for any purpose prohibited under applicable law, including, without limitation, any nuclear, chemical or biological weapons-related purpose.

11. Governing Law and Dispute Resolution

Any dispute arising out of or in connection with this EULA shall first be addressed through good-faith negotiation between the parties. If the dispute cannot be resolved amicably, it shall be brought before the competent courts of the jurisdiction in which Telestory is established. Nothing in this section deprives a consumer who is resident in the European Union, the United Kingdom, the Russian Federation, or another jurisdiction whose mandatory consumer protection laws grant the right to bring proceedings in their local courts of that right or of the protection of any mandatory consumer-protection rules of their country of residence. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this EULA.

12. Changes and Miscellaneous

Telestory may update this EULA from time to time. The updated version will be posted at this URL with an updated "Last updated" date; where reasonably possible, material changes will also be brought to your attention through the Software Product. Your continued use of the Software Product after the updated EULA takes effect constitutes your acceptance of the changes. This EULA, together with any platform-specific terms referenced above and the Refund Policy published on the Telestory website, constitutes the entire agreement between you and Telestory with respect to the Software Product and supersedes all prior agreements. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect. Telestory's failure to enforce any right or provision shall not be deemed a waiver. You may not assign this EULA without Telestory's prior written consent; Telestory may assign it without restriction. In the event of any conflict between the English and any translated version of this EULA, the English version prevails.

13. Privacy Policy — Scope

This Privacy Policy explains what information Telestory collects when you use the Telegram bot, the Android application, or the website telestory.net, how we use it, with whom we share it, and the rights you have. We are committed to processing personal data in accordance with the Russian Federal Law No. 152-FZ "On Personal Data", the EU General Data Protection Regulation (GDPR), the UK GDPR, the California Consumer Privacy Act (CCPA/CPRA), and other applicable data-protection laws. We try to collect and process the minimum amount of data necessary to operate, secure and improve our products. We do not sell or rent your personal information.

14. Information We Collect

We collect only what is needed to provide and improve the Software Product: • Telegram account data (when using the bot): your Telegram user ID, username, first name and language code as provided by Telegram when you start the bot. We do not see your phone number or your message history with other users. • Service data: identifiers of stories you have requested, the type of action performed (view, download, share), your subscription plan and activation date, and other data strictly necessary to deliver the requested feature. • Technical and usage data: device type and model, operating system version, application version, language and locale, screen size, anonymized device identifier, crash reports, performance metrics, the features you use, and aggregated usage statistics. • Web server logs: when you visit telestory.net, our servers may automatically record standard log information (IP address, browser type, referring page, pages visited, timestamps) for security, abuse prevention and analytics purposes. • Payment data: when you pay for a subscription, the payment is processed by the relevant store (Google Play, RuStore) or by an integrated payment provider (including Telegram Stars or YooKassa where applicable). Telestory does not receive or store your full bank card number; we receive only a transaction identifier and the status of the payment. We do not knowingly collect government-issued identifiers, biometric data or other special categories of personal data.

15. How We Use Information

We use the information described above to: • provide, operate, maintain and personalize the Software Product, including delivering the requested stories or downloads; • apply daily limits, manage subscriptions and verify access to paid features; • diagnose technical issues, monitor performance, prevent fraud and abuse, and improve features; • respond to user inquiries and provide customer support; • comply with legal obligations and enforce this EULA. We do not use personal information to build advertising profiles for sale to third parties.

16. Analytics and Third-Party Services

We use the following third-party analytics services to understand how our products are used and to improve them: • Google Analytics (Google Ireland Limited / Google LLC) — see policies.google.com/privacy; • Yandex Metrica (Yandex LLC) — see yandex.com/legal/confidential. These services may set cookies or use similar technologies and may process device identifiers and IP addresses. Where required by applicable law, we request your consent before activating non-essential analytics. You can opt out at any time via the opt-out tools provided by each service or via your device's tracking-control settings (for example, "Opt out of Ads Personalization" on Android). The Telegram bot operates on Telegram's infrastructure; your interaction with the bot is also subject to Telegram's Privacy Policy.

17. Sharing of Information

We share information only as described in this Privacy Policy: • with the analytics providers listed in Section 16, strictly for the purposes set out there; • with infrastructure and hosting providers that operate our servers under written confidentiality and data-protection commitments; • with the payment providers and app stores (Google Play, RuStore, Telegram, YooKassa) strictly to process your transactions; • where required by a valid legal process, court order, or to protect the rights, property or safety of Telestory, its users or the public; • in connection with a merger, acquisition, or sale of assets, subject to standard confidentiality protections. We do not sell, trade, or otherwise transfer your personal information to outside parties for their own marketing purposes.

18. Data Retention and International Transfers

We retain personal data only for as long as necessary for the purposes described in this Privacy Policy or as required by applicable law (including tax and accounting obligations for paid transactions). Aggregated, anonymized data, which cannot be used to identify you, may be retained indefinitely. The third-party services we use may process data outside your country of residence, including in the United States, the European Union, and other jurisdictions. Where required, such transfers are protected by appropriate safeguards (such as the EU Standard Contractual Clauses or equivalent mechanisms).

19. Your Rights

Depending on your jurisdiction, you may have the right to: • access the personal data we hold about you; • request correction or deletion of your data; • object to or restrict certain processing; • withdraw consent at any time, without affecting the lawfulness of processing carried out before withdrawal; • receive your data in a portable format; • lodge a complaint with a data-protection supervisory authority (in Russia — Roskomnadzor; in the EU — your local data protection authority; in the UK — the ICO). You may exercise these rights by contacting us at [email protected]. To delete your account in the Telegram bot, send the command /stop or contact support.

20. Cookies and Do Not Track

Our website telestory.net uses cookies and similar technologies that are strictly necessary for the operation of the site, as well as analytics cookies set by the providers listed in Section 16. Where required by applicable law, non-essential cookies are set only after you provide consent. You can control cookies through your browser settings; disabling certain cookies may affect site functionality. Because there is currently no industry-standard interpretation of "Do Not Track" (DNT) browser signals, we do not actively respond to them. We do, however, honor opt-out choices made through standardized mechanisms required by applicable law.

21. Children's Privacy

The Software Product is not directed to children under the age of 13 (or the equivalent minimum age in your jurisdiction), and we do not knowingly collect personal information from such children. If you are a parent or guardian and you believe your child has provided us with personal information, please contact us at [email protected] and we will take prompt steps to delete it.

22. Security

We implement reasonable technical and organizational measures designed to protect personal data against unauthorized access, alteration, disclosure or destruction, including encrypted transmission (HTTPS), restricted server access and regular security reviews. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

23. Changes and Contact

We may update this Privacy Policy from time to time. The updated version will be posted at this URL with an updated "Last updated" date. We encourage you to review the policy periodically. Nothing in this document is intended to limit or exclude rights you may have under mandatory consumer protection or data protection laws of your country of residence. Where such laws apply, they prevail over this document to the extent of any conflict.
